APPLE FEST TERMS & CONDITIONS

BY RESERVING SPACE I AGREE TO THE FOLLOWING CONDITIONS:

 

I. Terms of Agreement This agreement is for vendors at the Covington Apple Festival. All vendors are independent operators and acceptance of their operation will be at the sole discretion of the Covington Business Association (CBA). The vendor agrees that the CBA may revoke this agreement at any time for any reason. Non-compliance of the rules as outlined in this agreement or in further written notices will result in removal of vendor with no refund due vendor.

 

II. Booth Space and Size, All booth spaces will be 12 feet wide. The CBA will assign a booth space to each applicant whose application is accepted. Your booth must remain at the assigned location throughout the event. All booth space is assigned at the sole discretion of the Festival Committee and is not transferable. A vendor forfeits his spot upon termination of this agreement by either party, and may not transfer it to a third party. If the vendor arrives at the festival and the trailer does not fit into the contracted space the committee has right to deny set up or move vendor to another space (if available).

 

III. Rental Fees and Payments, Vendors will be charged $35 for non electrical and $40  for electrical service per booth space (Corner Booth prices are on application)  for the day, only 110 available, no 220. The rental fee is due back with vendor application and is not refundable.

 

IV. Set up and Tear Down Times, Set up of booths will be allowed, in agreement with the City Officials, and may vary per year dependent

upon community activities. No overnight security is available. The time will be included in the mailing that informs vendors of their booth space number which will be mailed at least 7 days prior to the festival.

Booths may not be dismantled before the 5:00 p.m. on Saturday. Vendors attempting to tear down or leave before the end of the event will be considered to be in violation of this agreement and will not be invited back for future engagements.

 

V. Access to Booth Space. Vendors may drive vehicles to booth location during set up and tear down, however no vehicles are to be left in the booth area after the event opens at 9:00 A.M. No exceptions. Your rental spot includes only the space indicated, and does not permit parking space for motor homes, campers, cars, trucks, trailers or other vehicles.

 

VI. Parking, Vendors are to move their vehicles off of the festival streets prior to 9:00 A.M. Any vehicle left in the festival area or blocking alleys or public right-of-way during festival hours will be towed at the owners' expense. No exceptions. FIRE LANES ON ALL STREETS AND ALLEYS MUST BE MAINTAINED AT ALL TIMES.

 

VII. Equipment, This agreement is for space rental only, and the CBA does not supply any equipment which may be necessary for the operation of vendor's booth. Tables, chairs, extension cords must be provided by the vendor, if needed for his operation. The CBA will not be responsible for manpower needed to place trailers' and equipment.

 

VIII. Security, The CBA will provide limited security coverage in all festival areas during the hours. However, the CBA will not be responsible for any equipment set up prior to 6:00 A.M. on the day of the Festival or left on the festival site after tear-down. The CBA is not responsible for accidents or lost, stolen or damaged items, equipment, etc.

 

IX. Clean-up, It is the responsibility of each contracted vendor to clean up around the contracted booth area on a continual basis throughout the duration of the festival and dispose of trash in appropriate containers provided by the CBA and City of Covington. Vendors will be billed for dump charges if trash is placed in private dumpsters. Vendors are to pick up and bag all trash before departure.

 

X. Revenue Regulations, All vendors will be individually responsible for compliance with any applicable State Law and Department of Revenue regulations.

 

XI. Release and Indemnification, Each vendor agrees to release and hold harmless the Covington Business Association and the Covington Apple Festival Committee and the City of Covington from any and all claims in any way arising from any and all injuries, losses and damages to person and property sustained or received by any person as a result of the vendor's participation in the Covington Apple Festival, and further agrees to indemnify the Covington Business Association, Covington Apple Festival Committee and City of Covington of and from any and all expense arising because of any claim which may hereafter be presented by anyone for loss and damage or person injury as the result of vendor's participation in the Covington Apple Festival.

 

XII. Determination, All matters regarding compliance with or violation of the above rules and regulations will be determined by the Apple Festival co-chairman, with the assistance of the Executive Committee of the Covington Business Association, and decisions are final. Any amendments and/or exceptions to the above rules and regulations will be determined by the Apple Festival Co-Chairman, with the assistance of the Executive Committee of the Covington Business Association, and all decisions are final.
